In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.

  1. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than   twelve (12) months past the termination of the user’s account. 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

  1. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time.   1. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this privacy notice.

California Residents

California Civil Code Section 1798.83, also known as the “Shine The Light” law permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Services, you have the right to request removal of unwanted data that you publicly post on the Services. To request removal of such data, please contact us using the contact information provided below and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Services, but please be aware that the data may not be completely or comprehensively removed from all our systems (e.g., backups, etc.).

Right to request deletion of the data — Request to delete

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, such as (but not limited to) the exercise by another consumer of his or her right to free speech, our compliance requirements resulting from a legal obligation, or any processing that may be required to protect against illegal activities.

In accordance with applicable law, we are not obligated to provide or delete consumer information that is de-identified in response to a consumer request or to re-identify individual data to verify a consumer request.

Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights

We will not discriminate against you if you exercise your privacy rights.

Right to Limit Use and Disclosure of Sensitive Personal Information

We do not process consumer’s sensitive personal information.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

  • You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.
  • You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.
  • You may request to opt out from future selling or sharing of your personal information to third parties. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than fifteen (15) days from the date of the request submission.

Colorado Residents

This section applies only to Colorado residents. Under the Colorado Privacy Act (CPA), you have the rights listed below. However, these rights are not absolute, and in certain cases, we may decline your request as permitted by law.

Virginia Residents

Under the Virginia Consumer Data Protection Act (VCDPA):

“Consumer” means a natural person who is a resident of the Commonwealth acting only in an individual or household context. It does not include a natural person acting in a commercial or employment context.

“Personal data” means any information that is linked or reasonably linkable to an identified or identifiable natural person. “Personal data” does not include de-identified data or publicly available information.

“Sale of personal data” means the exchange of personal data for monetary consideration.

If this definition of “consumer” applies to you, we must adhere to certain rights and obligations regarding your personal data.

Verification process

We may request that you provide additional information reasonably necessary to verify you and your consumer’s request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request.

Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

Right to appeal

If we decline to take action regarding your request, we will inform you of our decision and reasoning behind it. If you wish to appeal our decision, please email us at support@tincontv.com. Within sixty (60) days of receipt of an appeal, we will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may contact the Attorney General to submit a complaint.

  1. HOW CAN YOU REVIEW, UPDATE, OR DELETE THE DATA WE COLLECT FROM YOU?

Based on the applicable laws of your country, you may have the right to request access to the personal information we collect from you, change that information, or delete it. To request to review, update, or delete your personal information, please fill out and submit a data subject access request.

The TinconTv is designed to protect your information and enable you to choose what you share.

  • The TinconTv brings your favorite TV shows, short skits, under skitollywood and movies all into one place and recommends others you might enjoy.
  • TinconTv collects information about your views, downloads, activity in the TinconTv, the content you watch, and where you watch it in the TinconTv and in connected apps on any of your supported devices. We use this information to provide the service and to improve the TinconTv for you and others.
  • We also collect information about your views, downloads, activity in the TinconTv, the content you watch, and where you watch it to tailor features and offer personalized recommendations and to send you notifications. You can opt out of the use of data for this purpose, as described below.
  • We use information about the movies and TV shows you view and download to offer advertising to ensure that Ads in the TinconTv videos are relevant to you. You have choices with respect to this advertising, as described below.
  • To help identify and prevent fraud, information about how you use your device, including the approximate number of phone calls or emails you send and receive, will be used to compute a device trust score when you attempt to view. The submissions are designed so TinconTv cannot learn the real values on your device. The scores are stored for a fixed time on our servers.

TinconTv  allows you to watch your favorite TV shows and movies all in one place. You can watch content you have rented or viewd from TinconTv. If available, you can also access content through TinconTv, TinconTv channels, and your connected third-party video apps. You can access all of this content through the TinconTv across supported devices that are signed in to the same TinconTv ID.

Providing the TinconTv

We use your personal data to provide the services and features in the TinconTv. This information includes your account and payment information, which you can access and change in Settings.

TinconTv collects information about what you view and what you’re watching in the TinconTv on any supported devices signed in to the same TinconTv ID. TinconTv stores this information associated with your TinconTv ID so we can display what you’re watching across your supported devices. When you sign in to third-party apps, information about whether you have subscribed to those services is used to display content available to you. If you grant permission for a third-party app to be connected to the TinconTv, TinconTv will collect and store information about what you watch from that app on any of your supported devices, as well as your subscription status. TinconTv apps with supported content, such as TinconTv Music, will be automatically connected when you start using the TinconTv.

Information about what you’re watching will include what content you’re playing, when you played it, the device you played it from, and where in the content you paused or stopped watching. We also collect a detailed history of all playback activity for TinconTv channels and TinconTv.

If you allow the TinconTv to access your location, your location will be used to determine what’s available in your region, including local content like live games, events, and news. Some content includes geographically relevant ads.

Improving the TinconTv

TinconTv collects information about your usage of the TinconTv and your account, including the features you use (for example, Up Next or Library), items you search for, your interactions with notifications, content pages you browse or view, information on errors or crashes within the app, and your billing zip code. We use this information, approximate location information that does not identify you, and information about what you watch to help improve and optimize the service for you and others. We also collect information about your device such as the type of device, the channel through which your device was obtained, the version of your operating system, and the amount of free space on your device. We may use this information to assess whether requested content can be downloaded, to understand general trends in device usage and storage, and whether your device is connected by Wi-Fi or cellular. If you use SharePlay to watch content with other users, the TinconTv will collect that you watched that content during a SharePlay session and the number of devices that participated in the session, but does not collect any information to identify the participants of a SharePlay session.

Personalizing the TinconTv

We personalize the TinconTv to help you discover the content that’s most relevant to you. For example, we recommend movies that we think will be of interest to you based on movies you’ve previously watched. To provide personalization, we use information including what you watch, your views, subscriptions, downloads, browsing, and other activities in the TinconTv, as well as information from your account such as your age.

If you do not want TinconTv to use information about what you watch on this device in the TinconTv for personalization on all devices that support the TinconTv, you can turn off Use Play History in Settings.

Communicating with You

TinconTv may use information about your account, such as the TinconTv products you own, your subscriptions to TinconTv services, the TinconTv apps you download, and your billing zip code, to send you communications about the TinconTv and other TinconTv products, services, and offers that may be of interest to you, including TinconTv One. Details about your device, such as its device serial number, or details about your relevant Store subscriptions may be used to check eligibility for TinconTv offers. If you are in a Family Sharing group, TinconTv may send you communications about products, services, and offers available to you through Family Sharing. If you view an TinconTv One subscription, we may send you emails and push notifications about the features of each of the services for which you have subscribed. TinconTv may also use information about your activity within the TinconTv to send you emails and push notifications about new features, content, and offers available in the TinconTv. You can change your email preferences and opt out of receiving these emails by going to TinconTv.com account page Advertising

In the TinconTv, if you allow the TinconTv to access your location, your location may be used to serve geographically relevant ads.

For other apps such as the Store, TinconTv News, and Stocks, if the Personalized Ads setting is turned on, TinconTv’s advertising platform may use your information, including information about the movies and TV shows you view from TinconTv, to serve ads in those apps that are more relevant to you.

If you do not want to receive ads targeted to your interests from TinconTv’s advertising platform, you can choose to turn off Personalized Ads. Turning off Personalized Ads will prevent TinconTv from using your information for ad targeting. It may not decrease the number of ads you receive, but the ads may be less relevant to you.

Sharing with Third Parties

We provide some non-personal data to our advertisers and strategic partners that work with TinconTv to provide our products and services, help TinconTv market to customers, and sell ads on TinconTv’s behalf to display on the Store and TinconTv News and Stocks. For example, we may share non-personal data about your transactions and viewing activity, as well as aggregated user demographics such as age group, gender (which may be inferred from information such as your name and salutation in your TinconTv ID account), and region, to TinconTv strategic partners, such as content owners, so that they can measure the performance of their creative work, meet royalty and accounting requirements, and improve their associated products and services.

If you sign in to the TinconTv on a non-TinconTv device, TinconTv may share information with the platform provider to enable the app to function, so that content from your TinconTv  subscriptions appears on the platform, and to support platform features such as providing search results and personalized recommendations. This may include information about whether you have opened the TinconTv and, where available, whether you have subscribed to TinconTv  and TinconTv  channels. You can choose to stop sharing your subscription information in the TinconTv account.

On supported non-TinconTv devices, you can choose whether to share what you watch, buy, or rent in the TinconTv, including TinconTv , TinconTv TV channels, and other content (where available) with the provider of your third-party platform. This may include your profile name or other information used to match your data from the TinconTv with your account or profile on your non-TinconTv device. Your platform provider may use your information from the TinconTv to enable platform features such as displaying the shows you have in progress and personalized recommendations. You can turn this off by going to the TinconTv account page.

If you choose to sign in to the TinconTv on a non-TinconTv device, you should review the terms, privacy policies, and practices of the platform’s provider to understand what data it collects, uses, and shares.

Retention

We retain personal data associated with your views, downloads, and viewing activity on the TinconTv for different lengths of time depending on business need, contractual obligations, and legal requirements. We also retain a record of your view and downloads of content for at least as long as you have an account with us to allow you to download that content in line with our applicable terms.

Clear Play History

You can clear your play history in the TinconTv in your account. This will remove all TV shows and movies from your Up Next queue and disassociate any past playback history from your account. This will apply to your play data that is held and used by TinconTv on devices that use the same TinconTv ID. If you use a non-TinconTv device and have chosen to share what you watch with that platform’s provider, clearing your play history will not affect the play data that is stored by the platform’s provider. You should review the terms, privacy policies, and practices of the platform’s provider to understand whether you can delete the data stored by that provider.

Third-Party Connected Apps

You must grant permission for your participating third-party apps to be connected to the TinconTv to begin sharing what you watch from those apps with TinconTv. When you set up the TinconTv, you may be asked to grant permission for multiple applications at one time. Some of the apps may be apps that you do not yet have installed on that device, and your preferences will be applied if they are installed later. Whether or not you grant permission, you will be able to change your preferences for each app in Settings.

If at any time you decide you no longer want one of your third-party apps to be connected to the TinconTv, you may disconnect that app from the TinconTv and TinconTv will stop collecting your play data from that third-party app.

When removing a third-party app from the TinconTv, you may also choose to delete all play data information TinconTv has collected about content you’ve watched from that app. At any time, you may also choose to delete all of your play data information TinconTv has collected about all third-party content you watch in the TinconTv. Clearing your play history in any of these described instances only clears your third-party app play data that is held and used by TinconTv for the TinconTv. It does not affect any play data that is held separately by the third-party app provider (for example, within their own app or on their servers).

You should also review the terms, privacy policies, and practices of your participating third-party apps to understand how they use and share your play data and related information.

Group Recommendations

If you choose to enable Group Recommendations on an TinconTv, information about what you watch will be used to make group recommendations with any combination of opted-in users on the same TinconTv. If a child account is in the group, recommendations for children will be included, but their watch history will not be used. You can turn off Group Recommendations for your account.

Applicable Legal Basis for Processing Personal Data

We process your personal data in the TinconTv generally for performance of your contract with TinconTv, as necessary for providing the service, and to comply with our legal obligations. Where consent is the appropriate legal basis, we seek it in accordance with applicable local law.

Where applicable local law provides, we process personal data as necessary for purposes of our legitimate interests or those of a third party in order to:

  • Display available and relevant content to you, including from third-party services
  • Check eligibility for offers, help to improve and optimize the service for you and others, and send you communications about the TinconTv and other TinconTv products, services, and offers that may be of interest to you
  • Prevent fraud and other malicious activity.

The data used includes:

  • Your use of the TinconTv including features you use (for example, Up Next or gallery), items you search for, your interactions with notifications, content pages you browse or view, what you watch, view, subscribe to, and download, and information about errors or crashes within the app
  • Details about your account
  • The device trust score
  • Your location

At all times, information collected by TinconTv will be treated in accordance with TinconTv’s Privacy Policy, which can be found at TinconTv.com/privacy-policy
